What is family-based immigration?

Who can file a family-based petition?

United States citizens can file a family-based petition for a spouse, an unmarried child under 21, an unmarried or married son or daughter, a parent and a sibling if the US citizen is at least 21 years of age. Immediate relatives of citizens are not subject to annual caps, which usually shortens the wait.

Lawful permanent residents can file a family-based petition for a spouse and for unmarried children. Children under 21 fall in F2A and those 21 or older are F2B. These categories have annual limits, so you track timing with the State Department Visa Bulletin and with USCIS guidance on which chart to use when filing for adjustment of status.

What USCIS updated in 2025?

On August 1, 2025, USCIS issued new policy guidance that consolidates how officers review family-based immigrant petitions, including eligibility, evidence, interviews, approvals, and denials. In practical terms it means clean filings and strong proof of the relationship matter more than ever.

The Child Status Protection Act update is the change most families feel. For adjustment applications filed on or after August 15, 2025, a visa is considered available for CSPA age calculations using the Final Action Dates chart in the Visa Bulletin. Cases filed earlier keep the February 2023 approach. This can decide whether a child remains a child for immigration purposes, so filing strategy and timing are crucial.
