Spouse Visa Petitions (K-3 and K-4)

A U.S. citizen can petition for a K-3 non-immigrant visa for their foreign spouse to enter and stay in the U.S. while awaiting the approval of their immigrant visa petition. They may be eligible to apply for and be granted lawful permanent resident status (green card) while in the U.S. We assist clients with filing the Form I-130, Petition for Alien Relative and the accompanying documents such as proof of a valid marriage.

• Once in the U.S., the spouse can apply for a work permit (employment authorization)
• After three years of obtaining permanent residence through marriage to a U.S. citizen spouse, you can apply for citizenship
• If your foreign spouse has minor unmarried children or unmarried children under the age of 21, they can also come to the U.S. with your spouse under the K-4 visa
